at the top of the street. I identify Francis Roza Pereira,

Junior, in Court, as that man. When I reached the scene the

Chinese, who is defendant, was struggling with Pereira. I seized defendant's left arm. He was dressed in dark blue

or black clothing: he had no hat. Defendant was taken back

to the wooden enclosure on the Praya.

DAVID MORGAN sworn: "I am master of the S. S. Kwong Ying.

At 11.45 a.m. on February 24th. last I was walking along the

Praya near Statue Square. I was going East. I noticed a

rickshs going East just in front of me. I see Exhibit 0.5.

I mark it with a cross to represent my position at the time

and with a circle to represent that of the ricksha. It was

some 50,60 feet ahead of me. I heard the crack of a shot.

I saw the ricksha let down and the coolie bolt round the far

end of the hoarding. I saw a man between me and the rick-

sha, perhaps some 6 or 8 feet behind the ricksha. I saw a whiap of smoke rising just in front and above that man's

head. I saw the occupant of the ricksha fall out in the

road. All this happened in a flash, It was only when I sÁT the whisp of smoke that I was convinced that the crack had been that of a shot. The man behind the ricksha darted away across the Praya and into Wardley Stïït
